About us and these terms
Everything is Something ("we", "us", "our") is a sole trader operating in Victoria, Australia. These Terms of Use govern your access to and use of Knock Knock, our browser groovebox, available at knock.everything-something.com (the Service).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Access and eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement. Knock Knock is free and does not require an account.
Your beats
Everything you make in Knock Knock is yours. We claim no rights in your beats, your recordings or anything you export, and you may use them however you like, including commercially.
Your work is stored in your own browser. We do not hold a copy unless you share a beat, and we are not responsible for loss of work caused by clearing your browser data, changing device or browser, or the Service being unavailable. Use the export feature to keep copies.
Importing and recording audio
The Service lets you import audio files and record from your microphone. You are responsible for what you bring in. You must have the right to use any audio you import or record, and to share it if you choose to share a beat that includes it. Do not import or record audio you do not own or have permission to use, and do not record other people without their consent.
Sharing
The share feature turns a beat into a public link and lists recent shares inside the app. By sharing a beat you:
- Confirm you have the rights described above in everything the beat contains
- Grant us a non-exclusive, royalty-free licence to store, display and deliver the shared beat to anyone with the link, and to list it in the app, for as long as the share exists
- Accept that anyone with the link may play it and keep an editable copy of it in their own browser
Shares that include imported or recorded audio are deleted automatically after 7 days. We may remove any shared beat at any time, including where we receive a complaint from a rights holder or where it breaches these Terms.
Rights holders: if you believe a shared beat uses your work without permission, contact us at the address below with the link. We respond to such requests promptly.
Acceptable use
You agree not to:
- Share beats containing unlawful, abusive, hateful or sexually explicit material, or material that infringes anyone's rights
- Access the Service by automated means, or use it to create shares in bulk
- Interfere with, disrupt, or place undue load on the Service or its infrastructure
- Attempt to access data, storage or administrative features you are not authorised to use
- Use the Service in violation of any applicable law
We may block access or remove shared content for conduct that breaches these Terms.
Intellectual property
The Service itself, including its name, design, code, built-in sounds and original content, is owned by Everything is Something and protected by intellectual property laws. You may use the built-in sounds freely in your beats. These Terms do not grant you any right to use our branding.
Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability. We do not guarantee that the Service will be available, that shared links will remain live, or that your work will be preserved.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded. To the extent our liability cannot be excluded, it is limited, at our option, to resupplying the Service or paying the cost of resupply.
Termination
You may stop using the Service at any time; your work stays in your browser. We may suspend or discontinue the Service, or remove shared content, as described in these Terms. Provisions which by their nature should survive termination (including intellectual property and liability provisions) survive.
Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
Changes to these terms
We may update these Terms from time to time. The revision date above reflects the current version. Material changes will be noted on this page, and your continued use of the Service after a change constitutes acceptance of the updated Terms.
